Please read the following to learn more about the ways in which SPLMNS uses your personal data before you proceed with the use of any of SPLMNS Digital Platforms.
This Data Protection Policy has been drafted in English and may have been translated into other languages. In the event of any discrepancies between the English and the translated texts, the English text shall prevail and be used to solve doubts of interpretation.

YOUR INFORMATION IS PROCESSED IN GERMANY AND IN THE EUROPEAN ECONOMIC AREA (“EEA”), AND MAY BE PROCESSED ELSEWHERE DEPENDING ON THE LOCATION OF AFFILIATES, BUSINESS PARTNERS, AND OTHER ENTITIES WHO ARE PERMITTED TO ACCESS SUCH INFORMATION UNDER THE TERMS OF THIS DATA PROTECTION POLICY (LOCATIONS OUTSIDE THE EEA MAY INCLUDE COUNTRIES WHICH MAY NOT ASSURE AN ADEQUATE LEVEL OF DATA PROTECTION ACCORDING TO APPLICABLE LAWS IN THE EEA AND GERMANY). IF SPLMNS PROCESSES YOUR PERSONAL INFORMATION OUTSIDE THE EEA, ALL REASONABLE STEPS WILL BE TAKEN TO ENSURE THAT YOUR PERSONAL INFORMATION IS TREATED AS SAFELY AND SECURELY AS IT WOULD BE WITHIN THE EEA AND GERMANY AND UNDER THE GENERAL DATA PROTECTION REGULATION (“GDPR”).
The collection of personal data and how SPLMNS uses it
The processing, collection and use of your personal data will always have a lawful basis. This lawful basis can be SPLMNS’ performance of a contract with you, your freely given consent, compliance with a legal obligation or SPLMNS’ legitimate interest.
Specifically, SPLMNS may use your personal data for the following purposes:
- To publicly display certain information linked to your owned and operated business on beans:n:water.com or any of SPLMNS’ other Digital Platforms, including but not limited to: full business name, full address, opening hours, your profile picture and/or business logo, connected social media accounts as well as any content submitted by you;
- To list and link your business profile in regional and/or worldwide recommendation lists, guides, articles, etc.;
- To display your data in connection to any feature articles;
- To make location based recommendations to other users based on the criteria that are linked to a business;
- to provide and improve the SPLMNS Digital Platforms;
- to manage your user account on beans:n:water as well as the wider SPLMNS Digital Platforms;
- to enable you to enjoy and easily navigate the SPLMNS Digital Platforms;
- to ensure appropriate customer care;
- to inform you about SPLMNS products as well as products and services of SPLMNS’ commercial affiliates and other third parties if you have consented for SPLMNS to do so;
- to complete transactions concluded on the SPLMNS Digital Platforms;
- to provide you with services you request;
- to manage your account, including processing bills;
- to communicate with you in general;
- to respond to your questions and comments;
- to notify you about special offers that may be of interest to you;
- to prevent potentially prohibited or illegal activities;
- to customize the advertising offered to you;

The personal data SPLMNS collects from you
The personal data SPLMNS collects from you when you use SPLMNS websites may include but is not limited to the following categories of personal data:
For the use of SPLMNS Digital Platforms: email address, last name, first name, country of residence, date of birth, gender, password, IP address, SPLMNS content preferences, credit card number and billing information.

SPLMNS uses cookies when you visit the SPLMNS Digital Platforms. Please read and make sure that you understand our Cookie Policy.
Automatic information
SPLMNS automatically collects some personal data stored within your computer when you visit the SPLMNS Digital Platforms, regardless of whether you have registered for or created an account or not. For example, SPLMNS will collect your IP address, web browser software, and referring website. SPLMNS may collect information about your location or your online activity on the SPLMNS Digital Platforms. Collecting this information helps SPLMNS to customize your user experience and to monitor and analyze your use of the SPLMNS Digital Platforms and services. This information is also used for the technical administration of the SPLMNS Digital Platforms and for the optimization of the usability and functionality of the SPLMNS Digital Platforms.
Information-sharing and disclosure
SPLMNS may send personal data about you to third parties when:
- You specifically acknowledge and agree that SPLMNS may disclose your personal data to third parties contributing to the delivery of services you have requested;

Security
SPLMNS wants you to feel confident about using the SPLMNS Digital Platforms. For this reason, SPLMNS has implemented adequate technical and organizational measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration or disclosure. However, SPLMNS cannot guarantee that unauthorized third parties might maliciously access your personal data.
Identity theft and the practice currently known as “phishing” are of great concern to SPLMNS. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password or national identification numbers in a non-secure or unsolicited email or telephone communication.
SPLMNS has implemented procedures to be able to react in case of unauthorized access, use, alteration or disclosure of personal data. If you suspect that such an incident has occurred, please get in touch with SPLMNS via dataprotection@splmns.com.
If you communicate with SPLMNS by email, please note that the secrecy of internet email is uncertain. By sending sensitive or confidential email messages or information which are not encrypted, you are accepting the risk of a possible lack of confidentiality over the internet.
Your rights
You have the following rights under the DPA and GDPR:
- the right to be informed about SPLMNS’ collection and use of personal data;
- the right of access to the personal data SPLMNS holds about you;
- the right to rectification if any personal data SPLMNS holds about you is inaccurate or incomplete;
- the right to deletion – i.e. the right to ask SPLMNS to delete any personal data we hold about you;
- the right to restrict the processing of your personal data;
- the right to data portability – i.e. obtaining a copy of your personal data to re-use with another service or organization;
- the right to object to SPLMNS using your personal data for particular purposes;
- the right to revoke a given consent at any time; and
- further rights with respect to the objection to automated decision-making and profiling.
If you have any cause for complaint about SPLMNS’ use of your personal data, please contact SPLMNS’ dedicated team at dataprotection@splmns.com. We may require you to provide verification of your identity. If you are not satisfied with our response, you always have the right to lodge a complaint with the competent data protection authority within the EEA. Please note that in certain circumstances, SPLMNS may withhold access to your personal data where SPLMNS has the right to do so under applicable data protection legislation.
Updating/deleting your information
You may review, correct, update, change or request that SPLMNS deletes your personal data at any time by accessing your account on the SPLMNS Digital Platforms. SPLMNS will ensure that your personal data is deleted if there are no legal reasons obliging SPLMNS to keep your personal data.
Links to other sites
If any part of the SPLMNS Digital Platforms links to other websites external to SPLMNS, those websites do not operate under this Data Protection Policy. If you choose to visit an advertiser or click on another third-party link, you will be directed to that third party’s website. SPLMNS does not exercise control over third-party websites and therefore recommends that you read and understand the data protection policies posted on these other websites to understand their procedures for processing, collecting, using and disclosing personal data.
Our policy towards children
SPLMNS does not on purpose process personal data from children under 16. Where children under 16 use SPLMNS Digital Platforms, we advise that they obtain the permission of a parent or legal guardian, and SPLMNS recommends that parents or legal guardians clear their browser cache of cookies and take all other steps highlighted in this Data Protection Policy to minimize the personal data collected. When SPLMNS becomes aware that a child under 16 has provided SPLMNS with personal data without such permission, SPLMNS will delete such personal data.
Changes to this Data Protection Policy
This Data Protection Policy may be amended from time to time. If SPLMNS amends this Data Protection Policy, any changes will be immediately posted on the SPLMNS Digital Platforms and you will be deemed to have accepted the terms of the Data Protection Policy on your first use of the SPLMNS Digital Platforms following the alterations.

Precedence
In the event that the provisions of this Data Protection Policy conflict with the provisions of any third-party data protection policy, the provisions of this Data Protection Policy shall prevail.
Jurisdiction and applicable law
This Data Protection Policy and all matters arising out of or related to this Data Protection Policy shall be governed by the substantive laws of Germany, without regard to conflicts of laws and principles thereof.
Any controversy, claim or dispute between you and SPLMNS arising out of or relating to this Data Protection Policy shall be subject to the exclusive jurisdiction of the competent Courts of the City of Munich, and each party hereby irrevocably consents to the jurisdiction and venue of such court.
